Couple is charged for sex in subway

A couple has been charged after having sex in public on a Toronto subway train and platform.

The two were clearly visible to other passengers, including one who videotaped their brazen behaviour.

Toronto Transit Commission spokesman Brad Ross says it happened around 2:30 p.m. Sunday on a southbound train at the Spadina station.


The train was stopped for 14 minutes and police were called. At some point, the couple got off the train and continued on the platform.

When police arrived, the couple was charged with engaging in a lewd act.

Mr. Ross said they were taken to hospital as they both appeared to be extremely intoxicated.

“It is a public place. There are children, of course, and other customers, and engaging in sexual activity is something you might not want to do,” Mr. Ross said.

When asked how often such things are reported on the transit system, Mr. Ross said: “These things happen in stranger places.

“I don't see these reports very often, that's fair to say.”

Vagi-- er Spadina, is one of the busiest stations in the Toronto subway system. It's down in the Chinatown part of the City. My Union's Toronto office is down on Cecil Street, just off Spadina. When I used to have meetings to attend there I would always leave the car out in the suburbs and take the subway downtown. Spadina was the station I always went to.

When someone invades your home and steals your illegal stash, calling the cops may not be a good idea.

Suspects in Barrie home invasion arrested in North York

Two men were arrested in North York in connection with a home invasion in Barrie Thursday.

Barrie Police said two men posing as plainclothes officers forced their way into an apartment on Sawmill Road. At least one victim was handcuffed. The suspects stole a safe and fled in a taxi. With the assistance of the cab company, the taxi was located on Hwy. 400 in North York, and the suspects were taken into custody, Dec. 29.

Two men, ages 30 and 34, face charges, including impersonating a police officer, robbery, forcible confinement and breaching previous release and/or probation orders.

"Between the two of them, prior to this incident, the males were already out on bail for at least 48 other criminal charges from numerous different offence dates," Barrie Police said in a news release today. "At this time, police have not gained access to the safe, but information from the victims is that it may contain cash and drugs."

The victims escaped injury.

The cab driver, a 54-year-old man, was also arrested. He was charged with dangerous driving.â?¨- Andrew Palamarchuk

BARRIE, Ont. - The victim of a home invasion this week in Barrie is facing drug charges after his safe was taken by two men posing as undercover police officers.

The two men were arrested by Toronto police and the OPP on the Hwy. 400 at Finch.

When Barrie police opened the stolen safe they found a quantity of cash and marijuana.

A 22-year-old man has been charged with possession for the purpose of trafficking and breach of probation

Hamilton man arrested for allegedly stealing hit-and-run victim’s purse

HAMILTON, Ont.— The Canadian Press

Hamilton police say a man is facing charges after allegedly taking a woman's purse as she lay dead following a hit-and-run.

The 20-year-old woman was struck and killed early last Sept. 18 as she was crossing Main Street East.

Due to the force of the impact, police say her personal items were thrown several metres down the street.

Detectives say her purse contained a wallet with her identification and credit card and a credit card belonging to her boyfriend.

Police allege that while the woman's body was still on the street, a man took her purse and then fraudulently used the credit cards.

Jason Dave Trotter, 29, of Hamilton is charged with four counts of fraudulent use of a credit card, two theft charges and two possession charges

Man Shoots Himself

A 55 year old Meaford man is lucky to be alive, after suffering a gunshot wound to his left leg.

It happened when the gun discharged, as he was doing maintenance work on it.

Last Friday night – Grey County OPP were called to the Meaford Hospital by staff working on a gunshot wound.


The injury was not life threatening, and the victim was treated and released from hospital.

Police learned that the injured man was doin

g maintenance work on his .22 calibre Smith and Wesson revolver at his home in meaford when it discharged, hitting him in the leg.

He was able to perform first aid, then called a neighbour to help him get to the hospital.

No one else was at home at the time of the incident.

Grey County OPP say the gun is registered to the victim.

Chief Firearms Office is investigating.

Fleming Drive in flames

The east end of London, ON became a war zone Saturday night as hundreds of rioters in the Fanshawe College area of the city attacked police and burned vehicles.

More than 50 officers in full riot gear surrounded by an alcohol-fuelled mob on St. Patrick’s Day held a one-block sector of Fleming Drive for more than an hour before being repelled by a downpour of broken glass from thrown bottle, rocks and even wooden planks torn off of fences.

A TV news truck parked in the middle of the violence was overturned and set on fire. Flames shot 20 feet into the air interspersed by violent explosions, one of which illuminated more than a block of houses in bright orange and sent many in the crowd screaming for shelter.

Even as the truck was exploding, rioters were throwing bottles of alcohol at it causing many smaller blasts, each one inciting the crowd more than the last.

Many danced around the flames, while others fed the inferno with any wood they could find to keep it ablaze. Some risked injury by tossed a couch and a mattress into it as others roared their approval.

Not long after, at least one more vehicle was torched.

A firefighter on the scene told the Free Press that some rioters were treated for burns. It’s not known how serious those injuries are.

There were no reports of police or other emergency workers being seriously hurt.

“This is awesome, isn’t it?” one shirtless young man bellowed. “I’ve never seen anything like this.”

He was asked what started it.

“Well, over there, all these cops were on the street and we just started, ah, kicking down fences and throwing the wood at the cops and they backed off and then there was the CTV over here and a couple of the boys, they just tipped it over and a couple of the other boys, they just burnt it... That’s...the boys for you.”

Police kept most of the mob at bay until after 11 p.m., hauling away a few young men in handcuffs, but with each one they arrested countless more bottles smashed on and around their cars.

The crowd’s courage grew every time a bottle shattered on a windshield of a cruiser until police had no recourse but to retreat and leave the streets to the rioters.

The violent riot that rocked the city Saturday night may be the worst – but not the first time St. Patrick’s Day celebrations have rocked London.

In fact, every year, the police roll out Project LEARN (Liquor Enforcement and Reduction of Noise) and step up their patrols in student neighbourhoods near UWO, Fanshawe and along Richmond Row to curb the rowdiness, but the results seem minimal at best.

Among residents in the area, St. Patrick’s Day has become an annual horror show with no end in sight. Many said they’re fed up with the booze-soaked young people and want something concrete done after this year’s carnage.

Angry residents further north on Farnsborough watching the carnage blamed police for letting the situation get out of control. They said the crowd had been getting rowdier for hours and wished authorities had stepped in sooner before it was too late.

“You could see it coming,” the man, who didn’t want his name used, said. “Every year, something crazy happens on St. Patrick’s Day. I’m fed up with it.”

Seems to me they had brain injuries before the burns.
The only thing green about Obama's "green" agenda is the money that has been wasted.

Michael Rafferty has been found guilty of first-degree murder, kidnapping and sexual assault causing bodily harm in the murder of eight-year-old Tori Stafford.

Mr. Rafferty, 31, had pleaded not guilty in the April 2009 death.

After 10 weeks of at times graphic and disturbing evidence, the nine women and three men on the jury began their deliberations late Thursday after a full day of detailed instructions from Superior Court Judge Thomas Heeney.


The Crown alleged that Mr. Rafferty and girlfriend Terri-Lynne McClintic kidnapped Ms. Stafford outside her school in Woodstock, Ont., then drove to a rural area where the girl was raped and killed.

Ms. McClintic, who pleaded guilty two years ago to first-degree murder, initially told police Mr. Rafferty killed the girl, but testified at his trial that she delivered the fatal blows.

At one point during their deliberations, jurors returned to the courtroom to review the videotaped interview in which she accused Mr. Rafferty of being the killer.

No one will ever know whether the jury believed if Mr. Rafferty or Ms. McClintic wielded the hammer, whether they thought the abduction was random or targeted, or whether the sequence of events was planned all along — but the end result was the same for little Tori.

Whether Tori knew Ms. McClintic or she was lured away with talk of a dog, the eight-year-old with butterfly earrings and a skip in her step was still unwittingly led to her death on a sunny April day after school.

Whatever scenario the jury believed and whatever actually happened near Mount Forest, Ont., on April 8, 2009, Tori’s body — with 16 fractured ribs, internal injuries and a shattered skull — lay undiscovered for months wrapped in garbage bags under a pile of rocks in a desolate farmer’s field.

Ms. McClintic told the trial a horrifying story of a drug-addled couple abducting a young girl at random for the man’s sexual pleasure, then killing her with inconceivable brutality.

Mr. Rafferty used Ms. McClintic — no stranger to violence but also desperate to believe she had finally found a good man — as a pawn to do his perverse bidding, the Crown suggested.

An entirely different scenario was put forward by the defence, suggesting Ms. McClintic was completely in control that day, acting out her sickening torture fantasies with Rafferty oblivious to the truth of what was going on.

First-degree murder carries a mandatory life sentence with no chance of applying for parole for 25 years.

The 10-week trial, which began March 5, swung wildly from emotional testimony about Tori to intricate technical evidence to sensational glimpses into Mr. Rafferty’s busy social life.

Tori’s Grade 3 teacher, Jennifer Griffin-Murrell, wept as she described her happy-go-lucky student’s spunky personality and “mother hen” approach to the younger kids in the split Grade 2/3 class.

Tori spent her last day at her Woodstock, Ont., school on April 8 using a computer to research plants, sitting through a brief time out for goofing around and getting her tights wet by jumping in puddles, Griffin-Murrell said. As the dismissal bell rang at 3:25 p.m. Tori ran back to class to grab the butterfly earrings her mother had lent her that morning and walked out of Oliver Stephens Public School one minute after her classmates.

“OK, hon, we’ll see you tomorrow,” Griffin-Murrell recalled telling Tori as she walked out of school for the last time.

Several police officers also took the stand early on in the trial, though their testimony was at times no less emotional. The investigation into Tori’s disappearance and death is believed to be the largest such investigation ever in Canada and hundreds of police officers worked around the clock.

Veteran officer Det. Staff Sgt. Jim Smyth, best known for extracting a confession from sex killer Russell Williams, had to collect himself on the stand when he described discovering Tori’s remains.

When Ms. McClintic testified, her cross-examination by Mr. Rafferty’s lawyer revealed a chilling side — a “bloodthirsty” young woman who detailed endless torture fantasies in letters written to a jailhouse friend.

Mr. Rafferty himself remained largely an enigma to the jury. The only glimpse of his personality came late in the trial as 22 past girlfriends and flings took the stand, including 15 women he dated in the spring of 2009.

Charity Spitzig, a mother of four, forked over $16,835 to Rafferty from December 2008 until May 2009, when he was arrested.

Though the Crown explained — without the jury present — that they had instructed Spitzig not to say where the money came from, she nevertheless testified that she was giving Rafferty the money she made working as an escort.

The jury heard little else about Rafferty, even though police had unearthed a mountain of character evidence that was deemed inadmissible by Superior Court Judge Thomas Heeney.

Heeney concluded a police search of Rafferty’s laptop was unconstitutional, so jurors did not learn of the Google searches it contained for “real underage rape,” “nude preteen,” and other phrases suggestive of a sexual interest in children.

They also did not know police found evidence Rafferty had downloaded “substantial” amounts of child pornography and so-called “snuff” films — movies depicting actual murder — including one with a title indicating it involved a child.

There was also a lot of so-called “bad character” evidence that was kept from the jury.

A woman Rafferty met online alleged in a police report that he drugged, choked and raped her, but he was not charged.

A litany of past dates also reported he had a penchant for sexual choking. Some even complained of his “disconcerting” behaviour toward their children, the Crown said.

Tears flowed in court Tuesday in the final phase of the Victoria (Tori) Stafford trial, and even the man who murdered and raped the eight-year-old Woodstock schoolgirl three years ago seemed affected, wiping his eyes as powerful victim-impact statements were read to the packed courtroom.

Then, in a jarring address that did nothing to ease the sorrow, Michael Rafferty rose in the prisoner’s box to offer an apology of sorts, in which he voiced sympathy for the enormous suffering he has wrought, yet insisted that he remained innocent.

Sentencing judge Mr. Justice Thomas Heeney was unimpressed.

“You sir are a monster,” he told the sniffling 31-year-old killer, convicted Friday night of first-degree murder, sexual assault causing bodily harm and abduction.

“You have snuffed out the life of a beautiful, talented, vivacious little girl. a ‘tomboy diva’ in the trustful innocence of childhood.

“And for what? So that you could gratify your twisted and deviant desire to have sex with a child. Only a monster could commit such an act of pure evil.”

In all, eight short victim-impact statements were read out, five in person and three more by co-prosecutor Stephanie Venne.

And none resonated more strongly than that of Tori’s older brother, Daryn, now 14, who tried to convey what it is like “to have your world ripped out from under you in less than a day. No hugs, no ‘see you later, no goodbyes, just part of my heart ripped out.”

Their mother, Tara McDonald, spoke of the “excruciating, unexplainable pain and heartache” generated by the loss of Tori, kidnapped outside her school by Mr. Rafferty’s partner-in-crime Terri-Lynne McClintic and brought to him as he waited in a nearby parking lot.

Two years ago, Ms, McClintic was also sentenced to life imprisonment in Tori’s death, and she was the key witness at Mr. Rafferty’s trial.
Tori’s father, Rodney Stafford, spoke of “a day of horror that will live on within me, my family and millions of others for the rest of our lives.”

Then came Mr. Rafferty’s turn as he stood facing the court, wearing a three-piece suit and a striped tie.

Watched from the public seating area by nine members of the jury who attended the sentencing he said that “nobody has all the pieces of the puzzle,” that “I am truly sorry to the entire family,” and that “I am a very definite part of why Victoria is not here today.”

He added that he would also like to speak to Ms. McDonald “privately” to tell her something she does not know. Then, in his next breath he proclaimed that while “I am guilty of many things, and for that I am ashamed,” he stands behind his not-guilty plea.

“Classic psychopath,” one of the police officers who took a lead role in the investigation said afterward. “Right to the end, he’s still trying to manipulate people.”

Judge Heeney sentenced Mr. Rafferty to an automatic life sentence, with little chance of parole until at least 25 years have elapsed since his arrest.

By agreement between the Crown and defence lawyer Dirk Derstine he was also sentenced to two 10-year terms for the sexual assault and the abduction, to run concurrently.

As well, he was also placed under a lifetime firearms ban, placed on the sex-offender registry and ordered to provide DNA samples.

In theory, under the so-called “faint hope” clause of the Criminal Code, Mr. Rafferty could try seek parole after serving 15 years of his sentence.

The federal government scrapped that clause last year, but because Tori’s murder predated the change, the old rules apply.

Few such applications succeed, however, and in this instance the chances of Mr. Rafferty walking the street then – if ever – appear remote.

Daryn Stafford was in court but his victim-impact statement was read out for him.

It told of how “My sister was the only person I had to talk to;” of how he is now fearful, and of how Tori’s ghastly death has damaged the family.

“It’s like the world is playing a sick trick on me,” he wrote. “But it’s not. This is reality.”

His father Rodney told the courtroom the crime has made him realize “that evil does exist.”

And in an unscripted aside, he spoke to the killer directly, staring hard at him.

“She was stolen from us by you, you piece of shit,” he said.

Ms. McDonald described the pain of not watching her daughter grow up. The milestones of Tori’s life – graduation, her prom, marriage – have been replaced by grim anniversaries she said; The day the child was kidnapped in April, 2009; the day three months later when her decomposed body was found in woods near the small town of Mount Forest; the court dates.

Ms McDonld also addressed the cloud of suspicion that lingered over her and her former husband, Rodney Stafford, in the weeks that followed Tori’s disappearance.

“I have to live the rest of my life being stared at, listening to the whispers of strangers,” she said.

Court also heard statements from both of Tori’s grandmothers, two aunts and an uncle.

All alluded to the horror of the trial, and of knowing all the dreadful facts.

Before passing sentence, Mr. Justice Heeney also addressed his controversial exclusion of evidence seized from Mr. Rafferty’s laptop, which included child pronography.

The judge reiterated that the evidence was legally inadmissible because it breached the defendant`s Charter rights, and that his decision to exclude it ensured Mr. Rafferty received a fair trial.

He finished by thanking the lawyers and the jury.

For the last time, Mr. Rafferty slipped off the tie he was allowed to wear during his court appearances and handed it to one of the court officers And shortly after 11 a.m. he was led away.

This was a big deal. They broke into regular programming on CFOS to report it Friday night. I was impressed with their coverage.

I can't imagine there is. If this scumbag didn't qualify for it, who would?

The penalty for first degree murder is life in prison. After serving 25 years he can apply for parole. The chances of parole being granted to him are slim to nil. It is very unlikely he will ever see the outside of a prison again. The next 40 or 50 years of his life will be spent 23 hours a day in a tiny, windowless cell and one hour a day alone in a small courtyard. For his own safety he will be kept segregated from the general prison population. In the prison pecking order, child rapists or killers are the lowest of the low.

Man accused of swallowing stolen diamond passes real gem in Windsor, Ont.

Police in Windsor, Ont., say a stone passed this weekend by a man accused of swallowing a $20,000 diamond is the real thing.

Staff Sergeant Dave Kigar says the gem was expelled Saturday and tests confirm it was the missing diamond.

He says the stone has since been returned to its rightful owners.

Staff Sgt. Kigar says Richard Matthews, who was ordered to stay in police custody until the diamond was found, has been transferred to the county jail.

But the 52-year-old still has another stone to go, believed to be a cubic zirconia — a low-cost diamond substitute — like the stone he passed Friday.

Mr. Matthews is alleged to have switched a diamond at Precision Jewellers and swallowed the real one.

He is charged with theft and breach of court conditions, and is also wanted on warrants in Toronto.

And you thought you were having a bad day: Toronto driver crashes into nun, has iPhone stolen

A man crashed his car into a vehicle driven by a nun on her way to church – and then his day got even worse.

Police say the man drove into the nun’s car at about 6 a.m. in Toronto Sunday morning, sending her vehicle into a bus shelter at the corner of Keele Street and Eglinton Avenue West.

The man tried to contact police on his iPhone, but was too shaken to use the phone. A passerby offered to help him call for assistance, but then ran away with the man’s iPhone, police said.
Police do not have a description of the phone thief.

The nun was taken to hospital as a precaution. The man was treated at the site of the crash and was charged with careless driving.

WOODSTOCK - Oxford County's Crown attorney faces impaired driving charges after a man driving a pickup truck got stuck in a ditch and sparked a grass fire trying to get out.

Police and fire responded to the 911 fire call Saturday afternoon in Woodstock's north end.

Once on scene, police determined the driver of the pickup truck was trying to reverse his vehicle from a walking trail entrance when it got stuck in a ditch.

When the driver attempted to get the vehicle out, a small grass fire ignited from the engine being revved.

Police later charged Brian Crockett, 64, with impaired driving and failing to provide a breath sample.

The highly regarded lawyer is one of the Crown attorneys involved in the conviction of Michael Rafferty for the kidnapping, sexual assault and murder of eight-year-old Tori Stafford.

Crockett and police are not commenting on the charges.

Crockett is no stranger to impaired driving cases, having acted as Crown attorney prosecuting many of those offences in court.

He has a history of recommending stiff punishment for first-time offenders.

"This is an issue in which general deterrence is a consideration,"Crockett said during a 2005 impaired driving case.
"Even though (the accused) didn't have a criminal record prior to the conviction, the circumstances surrounding the driving warrant a jail sentence."
Crockett was officially sworn as the Crown attorney for Oxford County on June 29, 2007, but had served as acting Crown attorney for the county since October 2003.

The current Crown attorneys need to take Crockett's prior statements to heart and charge him accordingly.

A jail sentence is most certainly called for.
